We can help you register the change of ownership at USPTO or CIPO so the owner on record is updated.
We can also help you update the owner on record in other jurisdictions through our network of foreign associates.
It is very important that the documents are done right or you risk the trademark becomes cancelled.
You usually need to register the change of ownership for following reasons:
- Transfer of ownership to a different entity
- Change of business entity of the owner
- Name change
Different types of change
Transfer of registered trademarks
A written agreement called a “Trademark Assignment” will need to be filed at USPTO. This is a document that effects the transfer of ownership, so that the trademark’s underlying goodwill is transferred to the new owner.
Depending on the party that requests the change to be recorded, CIPO has different requirements for the documents.
Transfer United States trademark applications filed on the intent-to-use basis
If you’re transferring ownership to a business successor for the goods or services listed in your identification, you can file your assignment at any time. This requires the transfer of your entire business or the part of your business associated with the goods or services associated with the trademark applications.
Otherwise, you must wait until after you file an Amendment to Allege Use or a Statement of Use before you file your assignment.
Name change
This is when the name or status of the owner changes. A request must be filed at the USPTO or CIPO so that the records are updated to reflect the change.
